Notice from the Department of Science and Technology of Guangdong Province on Carrying out the Recognition of High level Talents from Foreign Countries, Hong Kong, Macao, and Taiwan

In order to implement the spirit of documents such as the "Notice of the People's Government of Guangdong Province on Forwarding the Reply of the Ministry of Public Security on Implementing Relevant Exit and Entry Policy Measures to Support the Construction of Guangdong Free Trade Zone and Innovation Driven Development" (Yuefu Letter [2016] No. 226), the "Notice of the People's Government of Guangdong Province on Forwarding the Reply of the Ministry of Public Security on the Recognition Standards for Foreign High level Talents Applying for Permanent Residence" (Yuefu Letter [2016] No. 352), and the "Decision of the People's Government of Guangdong Province on Adjusting and Implementing a Batch of Provincial Rights and Responsibilities List Matters" (Provincial Government Order No. 270), 16 exit and entry policy measures supported by the Ministry of Public Security for the Construction of Guangdong Free Trade Zone and Innovation Driven Development will be implemented, providing entry and exit and residence convenience for foreign, Hong Kong, Macao, and Taiwan high-level talents. The relevant matters regarding the recognition of foreign and high-level talents from Hong Kong, Macao, and Taiwan in Guangdong Province (hereinafter referred to as the "recognition work") are hereby notified as follows:

1Recognition criteria and scope

Foreign talents and permanent residents of Hong Kong, Macao, and Taiwan who meet the conditions listed in the "Guangdong Province Guidelines for the Recognition and Handling of High level Talents from Foreign Countries, Hong Kong, Macao, and Taiwan" and come to Guangdong for work or entrepreneurship.

2Certification authority

Foreign expert centralized management departments authorized by the provincial people's governments, including cities at or above the local level, Hengqin Guangdong Macao Deep Cooperation Zone, China Singapore Guangzhou Knowledge City, China (Guangdong) Pilot Free Trade Zone Shenzhen Qianhai Shekou Area, and China (Guangdong) Pilot Free Trade Zone Guangzhou Nansha New Area, etc. (hereinafter referred to as "foreign expert centralized management departments"), shall comprehensively accept and recognize applications within their jurisdiction in accordance with the principle of territorial management, and carry out permanent residence recommendations (for departments with recommendation authority).

3Identification Procedure and Time Limit

The certification work has been approved through the "Guangdong Province Science and Technology Business Management Sunshine Government Platform" (hereinafter referred to as the "Sunshine Government Platform", website: http://pro.gdstc.gd.gov.cn/ The entire process is handled online, without the need to submit paper materials for verification (except for sensitive materials).

1Employers register their accounts online. Employers log in to the Sunshine Government Platform and complete account information registration (including basic information such as company name, unified social credit code, company administrator information, competent department, and company contact information). If the employer already has an account on the platform, there is no need to register a new account. If the employer is a university that operates in a different location, each campus shall register accounts separately according to the principle of territorial management.

2Submit an application and be recommended by the employer. The applicant submits relevant application materials to the employer, and the employer administrator logs in to the Sunshine Government Platform to enter the application, upload relevant attachment materials, and complete the online application.

3The department responsible for the centralized management of foreign experts accepts and confirms the application. The department responsible for the centralized management of foreign experts shall accept the application within 5 working days from the date of material submission (excluding the day of material submission), and complete the identification work within 15 working days from the date of application acceptance. If other materials need to be supplemented during the identification process, the acceptance period shall be recalculated from the date of supplementation. Upon recognition, provide the employer with a "Confirmation Letter for Foreign High level Talents in Guangdong Province" and a "Confirmation Letter for High level Talents in Hong Kong, Macao, and Taiwan in Guangdong Province"; Notification of reasons for non acceptance.

The validity period of the "Confirmation Letter for Foreign High level Talents in Guangdong Province" and the "Confirmation Letter for High level Talents in Hong Kong, Macao, and Taiwan in Guangdong Province" shall be from the date of approval until the expiration of the labor contract, with a maximum of 5 years. If there is a change in the application conditions of the workplace, etc., a new application should be made for processing.

4Recommendation for permanent residency of high-level foreign talents. Foreign talents in the nine cities of the Pearl River Delta (Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen, Zhaoqing) and the jurisdiction of Jieyang Sino German Metal Ecological City who need to apply for a recommendation letter for permanent residence in China shall submit relevant application materials together with the application for high-level talent recognition. After the local foreign expert centralized management department reports to the people's government of the city at or above the prefecture level or the Economic Development Bureau of Hengqin Guangdong Macao Deep Cooperation Zone, the Management Committee of Guangzhou Economic and Technological Development Zone, the Management Committee of Shenzhen Qianhai Shekou Area of China (Guangdong) Pilot Free Trade Zone, the Working Office of Nansha New Area of China (Guangdong) Pilot Free Trade Zone and other authorized units of the provincial people's government for approval, a document titled "Guangdong Province Foreign High level Talent Application in China" shall be issued. Recommendation Letter for Permanent Residence in China, Report the situation to the entry and exit management department of the local public security organ.

4Required materials for identification

1Confirmation Registration Form (see Attachment 1 and Attachment 2): Fill out and print in Chinese online, sign by the applicant, and the employer will provide a recommendation with an official seal. Scan and upload it to the system.

2The applicant must provide a valid passport or other international travel document: the information page of the passport, international travel document, Hong Kong and Macao residents' Mainland Travel Permit, or Taiwan residents' Mainland Travel Permit must be provided.

3Materials for working or starting a business in Guangdong: For those who have already worked or started a business in Guangdong, they should provide "Foreigner's Work Permit for China" or the cultural department's approval of the content and performers of foreign artistic performance groups coming to China. They should have professional qualifications for industry access or foreign pilots, foreign attendants, foreign doctors, foreign football and basketball players and other foreigners from special industries working in China.

4Other materials: Materials that can prove that they belong to the following three categories of foreign high-level talents as stipulated in the "Identification Measures":

1. Winners of well-known awards or selected candidates for major talent projects;

2. Renowned foreign experts and scholars;

3. Foreign high-level talents in enterprise innovation and entrepreneurship.

All non Chinese materials mentioned above require a Chinese translation, except for passports or international travel documents; All original non sensitive paper materials and Chinese translations shall be uploaded to the Sunshine Government Platform as scanned copies of the original documents; All uploaded materials must be stamped with the official seal of the employer. The original sensitive materials must be verified.

5Job requirements

1Strengthen leadership and ensure strong support. Each region should establish a sound job responsibility system in accordance with the requirements of this notice and the "Identification Measures", clarify the acceptance process and responsible units for the identification work, and publish them on the government portal website.

2Pay attention to publicity and handle it seriously. Each region should actively carry out policy promotion and interpretation, so that employers and applicants are aware of the policy content, and improve the social awareness and influence of various talent policies and entry and exit facilitation measures. We should conscientiously carry out business learning and training, ensure that business personnel are familiar with policy and business, carefully verify the legality, authenticity, completeness, and timeliness of submitted materials, and ensure that those who meet the conditions should complete them, and those who do not meet the conditions will not be processed.

3Overall coordination and close cooperation. The recognition of high-level talents from foreign countries, Hong Kong, Macao, and Taiwan is an important prerequisite for implementing the 16 entry and exit policy measures and providing entry, exit, and residence convenience for foreign high-level talents and innovative and entrepreneurial talents. The Provincial Department of Science and Technology will strengthen guidance, supervision, and management of work in various regions. The departments responsible for the centralized management of foreign experts in various regions should actively strengthen communication with organizations, public security, foreign affairs, Hong Kong, Macao, Taiwan and other departments, timely solve problems, ensure smooth connection between various links, and form a joint force.

4Integrity first, eliminate fraud. The applicant and their applying unit shall be responsible for their application materials, and shall prevent fraud. Once any violation is found, corresponding legal responsibilities shall be pursued according to the severity of the circumstances.

This notice shall come into effect from the date of issuance and be valid for five years, and shall be interpreted by the Provincial Department of Science and Technology.
